The Copyright Office is Wrong About AI-Assisted Works – Van Lindberg, OSPOCO

In February of this year, the US Copyright Office issued its decision regarding Zarya of the Dawn, finding that the AI-assisted pictures in the comic book were not copyrightable under law. The USCO issued a letter at the same time laying out its analysis.

The problem is that the analysis was wrong. I argue that the current policy of the USCO regarding AI-assisted works is untenable and will eventually be overturned.

Why?

We have had all of these arguments before, about 150 years ago, relative to photographs. Photographs once faced the same issues that AI-assisted works face today. But there was an additional 100 years of precedent that have been ignored, all of which suggest that AI is eventually going to end up being considered only as a tool, just like all the other tools we use to create copyrightable works.
